1. Acceptance of Terms

Welcome to Listmyproperty.ng. By accessing or using our website, mobile app, or any of our services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you are using our services on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

These Terms constitute a legally binding agreement between you and Listmyproperty.ng. Please read them carefully before using the platform.

2. Eligibility

You must be at least 18 years old to create an account or use our services. By registering, you confirm that:

You are at least 18 years of age
You have the legal capacity to enter into a binding agreement under Nigerian law
You are not barred from using our services under any applicable law
All information you provide is accurate and truthful

We reserve the right to suspend or terminate accounts of users who misrepresent their age or identity.

3. Your Account

When you create an account, you are responsible for:

Keeping your password secure and confidential
All activity that occurs under your account
Notifying us immediately at support@listmyproperty.ng if you suspect unauthorised access
Ensuring your contact details (email, phone, WhatsApp number) are kept up to date

You may not share, sell, or transfer your account to another person. Each account is personal and non-transferable.

We reserve the right to suspend or permanently delete accounts that violate these Terms, post fraudulent content, or engage in abuse of the platform or its users.

4. Property Listings

Agents and Landlords who list properties agree that:

All information in the listing is accurate, complete, and not misleading
You have the legal right to sell, rent, or advertise the property
You own or have explicit written authorisation from the property owner to list it
Listed prices are genuine and will be honoured — no bait-and-switch pricing
Property photos are of the actual property being listed, not stock images
You will update or remove listings that are no longer available within 48 hours of the property being let or sold

All listings are subject to review by our moderation team. We reserve the right to reject, remove, or edit any listing that violates these Terms or our listing guidelines without notice.

Posting fake, duplicate, or misleading listings is a serious violation and will result in permanent account suspension. We actively report fraudulent agents to relevant Nigerian authorities.

5. Prohibited Conduct

You agree not to:

Post false, misleading, or fraudulent property information
Impersonate another person, agent, or company
Use the platform to conduct fraud, advance fee scams, or any criminal activity
Collect contact information from buyers for purposes unrelated to genuine property transactions
Send spam or unsolicited marketing messages to other users
Attempt to bypass, hack, or disrupt our platform's technical infrastructure
Scrape, crawl, or systematically extract data from the platform without our written permission
Post content that is defamatory, discriminatory, obscene, or in violation of Nigerian law
Use our platform to launder money or facilitate any financial crime
List properties in areas restricted by law without appropriate authorisation

Violations of these prohibitions may result in immediate account suspension, removal of all your listings, and where appropriate, referral to Nigerian law enforcement agencies.

6. Payments & Subscription Plans

Free tier: The basic plan is free and includes up to 5 active listings. No payment information is required.

Paid plans: Pro and Premium subscription plans are available with additional features. Payment is processed in Nigerian Naira (NGN) via Paystack or Flutterwave.

Listing boosts: One-time promotional placements (Featured, Sponsored) are charged per listing per period.

Refund policy: All subscription and boost payments are non-refundable once the service has been activated, as benefits begin immediately. If you believe there has been a billing error, contact us within 7 days of the transaction at support@listmyproperty.ng.

No auto-renewal: We do not automatically charge you at the end of your plan. You will receive a reminder before expiry and must actively renew.

We are not responsible for losses arising from payment processing errors by Paystack or Flutterwave. Please contact your bank or those payment providers for card-related issues.

7. Intellectual Property

The Listmyproperty.ng name, logo, design, software, and all content created by our team are owned by us and protected by Nigerian and international intellectual property laws.

Your content: When you upload photos, descriptions, and other content to our platform, you grant us a non-exclusive, royalty-free licence to display, reproduce, and distribute that content on our platform and in promotional materials. You retain ownership of your content.

You warrant that any content you upload does not infringe the rights of any third party. If you believe content on our platform infringes your intellectual property, contact us at support@listmyproperty.ng.

8. Disclaimers

Listmyproperty.ng is a marketplace platform. We connect property sellers and agents with buyers and tenants. We do not own, manage, or control any listed property.

We are not a party to any transaction between a buyer/tenant and an agent/landlord. We do not verify ownership of every listed property and are not responsible for any fraudulent listings.

Our platform is provided "as is" and "as available." We do not guarantee:

That the platform will be uninterrupted or error-free
That listings are accurate, complete, or current
That any agent or landlord on the platform is legitimate or trustworthy
That any property transaction will be successfully completed

Always conduct independent due diligence — visit properties in person, verify documents, and use trusted legal professionals for property transactions in Nigeria.

9. Limitation of Liability

To the maximum extent permitted by Nigerian law, Listmyproperty.ng, its directors, employees, and partners shall not be liable for:

Any loss arising from reliance on content posted by third-party users
Financial losses from property transactions conducted through leads generated on our platform
Loss of data, revenue, or profits due to platform downtime
Any indirect, incidental, or consequential damages

Our total liability to you for any claim arising from your use of the platform shall not exceed the total amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Listmyproperty.ng and its team from any claims, damages, losses, or legal expenses (including reasonable legal fees) arising from:

Your use of the platform in violation of these Terms
Content you post that infringes a third party's rights
Any fraudulent or illegal activity you conduct on or through the platform
Any dispute between you and another user of the platform

11. Termination

By you: You may close your account at any time by emailing support@listmyproperty.ng. Closing your account will delete your listings and profile data subject to our retention policy.

By us: We may suspend or terminate your account immediately, without notice, if we determine that you have violated these Terms, posted fraudulent content, or pose a risk to other users or the platform.

Upon termination, your right to use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, liability limitations, and indemnification) will continue to apply.

12. Disputes & Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

In the event of a dispute, we encourage you to first contact us at support@listmyproperty.ng to resolve the matter informally. Most concerns can be resolved within 5 business days.

If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the courts of Lagos State, Nigeria, unless otherwise required by applicable law.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, Nigerian law, or industry standards. When we make material changes, we will:

Update the "Last updated" date at the top of this page
Email registered users with a summary of the key changes
Display a notice on the platform at least 7 days before changes take effect

Your continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.
